Terms of Service
1. Acceptance of Terms
By accessing or using ClipHarvest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, do not use the Service. Use of the Service constitutes full acceptance of these terms.
2. Description of Service
ClipHarvest is a web-based tool that automatically analyzes uploaded video files and extracts segments containing significant motion, scene changes, or other detected activity. The Service returns a processed video file containing the extracted highlight segments. We do not store, review, or use your video content for any purpose other than performing the requested analysis.
3. User Responsibilities
You are solely responsible for the content you upload. By uploading a video you represent and warrant that:
- You own the video or have all necessary rights, licenses, and permissions to upload and process it.
- Your upload does not violate any applicable law, regulation, or third-party right.
- You are at least 13 years of age (or 16 if you are in the European Union).
4. Prohibited Content
You may not upload any content that:
- Depicts child sexual abuse material (CSAM) or any sexual content involving minors. Violations will be reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement.
- Is illegal under applicable federal, state, or local law.
- Infringes the copyright, trademark, privacy, or other intellectual property rights of any third party.
- Depicts non-consensual acts or harassment.
- Is intended to facilitate illegal activity.
We reserve the right to terminate accounts and refuse service to anyone for any reason, including violation of these prohibitions.
5. File Retention and Data Handling
Uploaded video files and processed output files are automatically deleted 7 days after processing completes. Uploaded files that do not complete processing (orphaned uploads) are deleted within 24 hours. We do not guarantee preservation of your files. Download your output promptly. We make no warranty regarding file retention and accept no liability for files deleted in accordance with this schedule.
6. Service Availability
The Service is provided on a best-effort basis. We do not guarantee uptime, processing time, or availability. Free tier users have no service level agreement (SLA). Pay-per-use customers have priority queue access but no guaranteed SLA. We may modify, suspend, or discontinue the Service at any time with or without notice.
7. Payment Terms
Free tier usage requires no payment. Pay-per-use processing is billed at $1.00 USD per hour of input video duration, rounded up to the nearest whole hour. Payment is collected via Stripe before processing begins for videos exceeding the free tier limits. By submitting payment you agree to Stripe's terms of service. We do not store your payment card information.
Example: a 90-minute video is billed as 2 hours ($2.00 USD). A 3-hour 5-minute video is billed as 4 hours ($4.00 USD).
8. Refunds
Refunds are governed by our Refund Policy, which is incorporated by reference into these Terms.
9. Intellectual Property
You retain all intellectual property rights in the content you upload. By uploading, you grant ClipHarvest a limited, non-exclusive, non-transferable license to process the video solely for the purpose of providing the Service to you. This license terminates when your files are deleted. We claim no ownership over your content and do not use it for training machine learning models.
10. Limitation of Liability
To the fullest extent permitted by law, ClipHarvest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or loss of business, even if advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 30 days preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce specific results from your video.
12. Indemnification
You agree to indemnify, defend, and hold harmless ClipHarvest and its operators from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Jurisdiction and venue shall be as specified by the operator. Any disputes arising under these Terms shall be subject to binding arbitration or exclusive jurisdiction of courts as specified by the operator upon request.
14. Account Termination
We reserve the right to terminate or restrict your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, any pending uploads may be cancelled without refund if the prohibition violation was the cause of termination.
15. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be indicated by updating the "Last updated" date at the top of this page.
